PARTICIPATION AND PHOTO WAIVER AND RELEASE 
 

I, my heirs and or assigns, (the “Participant”) do hereby agree to the following: 

 1. Assumption of Risk and Release 

•  a.    Participation in any event sponsored by, at the facility of, or under the auspices of the Peace River Picklers, Inc. (“PRP”)) carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries.  This includes any demonstrations, one time classes or other events, as well as normal membership activities (the “Activities”).  

 

• b.    The specific risks vary, but include 1) minor injuries such as bruises, sprains and dehydration, 2) major injuries such as eye injuries, joint, bone or back injuries, heat stroke, heart attacks and concussions, and 3) catastrophic injuries such as paralysis and death. I have read the previous paragraphs and With full knowledge of such risks, and in consideration of my being permitted to participate in the Activities I affirm that my participation is voluntary, and  I hereby assume all such risks, known and unknown, and waive, release, and covenant not to sue, and hold PRP and its officers, employees, contractors and volunteers (the “Released Parties”) free and harmless with respect to any and all claims including but not limited to claims of negligence, and liabilities for bodily injury, illness, death, or property loss arising out of my participation in the Activities 

 

• c.    Furthermore, I agree to indemnify and hold the Released Parties harmless from any and all claims, actions, suits, costs, expenses, damages, and liabilities, including attorney fees, (including but not limited to those of a monetary nature) that may be incurred by as a result of my involvement in the Activities. 

 
  2. Photo Waiver  

• a.    I hereby grant PRP Inc. permission to use my likeness in a photograph, video, or other digital media (“photo”) in all its publications, including web-based publications, without payment or other consideration. I understand and agree that all photos will become the property of the PRP, Inc. and will not be returned. I hereby irrevocably authorize the PRP, Inc. to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose.  In addition, I waive any right to inspect or approve the finished product wherein my likeness appears.  Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo. 

 

• b.    I hereby hold harmless, release, and forever discharge the PRP, Inc. from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of any usage or ownership of any photo. 

 
3. Rights  

• a. I understand that by signing this Release and Waiver that I may be giving up certain rights. 

 
4. Surviving Provision  

• a. This Release and Waiver shall be binding upon my survivors, heirs, successors, and assigns.
